Army Corps of Engineers in Louisville issue cease and desist for infill at Silver Creek dam
Construction at a dam in New Albany has hit another roadblock.
The U.S. Army Corps of Engineers has issued a cease and desist order to New Albany Mayor Jeff Gahan for infilling the Providence Mill Dam.
The order says the Corps did a site inspection at the dam on Aug. 6, gathering that work was being done without the required authorization from the Department of the Army.
They said New Albany violated Section 10 of the Rivers and Harbors Act and Section 404 of the Clean Water Act.
A spokesperson for the Corps said that fill material was unloaded into 0.3 acres of the Providence Mill Dam.
Since the city did not have a permit for the work, the Corps says the work must be undone and the dam restored to its original condition.
New Albany will also have to submit restoration plans to the Corps and have them approved before beginning to remove the fill.
This comes a week after the Indiana Department of Natural Resources ordered the city to stop work on the dam, where crews were unloading rocks into the water.
Gahan had approved emergency maintenance to the dam earlier this month after a 14-year-old boy drowned in the dam on Memorial Day.
The DNR issued an infraction to Gahan for this.
