기본권3각관계 (Constitutional Rights’ Triangular Relationship)

기본권3각관계에 관한 논의가 그동안 없었던 것은 아니다. 그러나 그러한 논의가 다양하기는 하였지만, 단편적인 것에 그쳤을 뿐 아니라 서로 간의 관련성을 제대로 살피지 않은 문제점이 있었다. 이것은 결국 개별 논의만 강조되어 정작 기본권3각관계 자체는 소홀히 다루어지는 결과를 낳았다. 그로 말미암아 기본권문제는 개별적인 해결로 그칠 수밖에 없었다. 하지만 기본권3각관계는 피해자왿� 가해자의 관계왿� 피해자왿�국가의 관계 그리고 가해자왿� 국가의 관계로 나누어진다. 그리고 이 세 관계는 서로 엄격하게 구별되는 것이 아니라 서로 밀접한 관련이 있다. 따라서 이 세 관계는 따로따로 고찰될 수 없고 반드시 통합적으로 고찰되어야 한다. 이러한 점에서 그동안 논의는 부분적인 것에 그쳤다고 볼 수 있다. 기본권3각관계의 성격을고려하여 살펴보면, 그동안 논의가 어느 부분에서 논의가 되는 것이고 의미가 있는지가 잘 드러난다. 그리고 그러한 논의가 기본권문제 해결에 어떻게 이바지하는지를 명확하게 이해할 수 있다.
기본권3각관계는 개인에 대한 개인의 관계이므로 사법관계이다. 피해자왿� 가해자의 관계는 기본권3각관계의 고갱이(핵심)로서 기본권문제 해결의 방식과 형태를 확정하고 나머지 두 관계를 결합하는 끈이 된다.
피해자왿� 국가의 관계는 피해자왿� 가해자의 관계에서 발생한 문제를 해결하는 기준을 제시하고, 가해자왿�국가의 관계는 문제를 해결하는 보호조치의 한계를 설정한다. 피해자왿� 국가의 관계에서는 위헌심사기준으로 과소보호금지원칙이 제시되고, 가해자왿� 국가의 관계에서는 위헌심사기준으로 과잉금지원칙이 나타난다. 과소보호금지원칙과 과잉금지원칙은 서로 심사내용이 다르고 기능도 다르다. 따라서 세 관계가 통합적으로 고찰되는 기본권3각관계에서는 과소보호금지원칙과 과잉금지원칙이 결합한 것이 위헌심사기준이 되어야 한다.

There have been a variety of discussions on the constitutional rights’ triangular relationship. However, they’ve merely explored the topic in a piecemeal fashion by not examining how the relevant constitutional rights are related to one another. That results in most scholarly attentions focusing on individual parts of the topic and not the triangular relationship itself. Thus, separate solutions are the only ones that have been available to constitutional rights issues. The constitutional rights’ triangular relationship consists of the relationship between a) a wrongdoer and a wronged party, b) a wronged party and the state, and c) a wrongdoer and the state. Since the three relationships are not strictly distinguished but closely related, they cannot be examined separately but have to be examined holistically. In light of that, discussions on the triangular relationship have merely covered parts of the subject only. Close examination on the nature of the constitutional rights’ triangular relationship will reveal which relationship of the there the discussion addresses and it has significance in and how it contributes in resolving constitutional rights issues.
Constitutional rights’ triangular relationship is a private law one as it is a relationship between private actors (individuals). The relationship between a wrongdoer and a wronged party is the heart of the triangular relationship that determines the means and forms of solutions to the constitutional rights issues and works as a link to the rest two relationships together. The relationship between a wronged party and the state provides a standard of resolving issues arising out of the relationship between a wrongdoer and a wronged party. The relationship between a wrongdoer and the state defines the limits of the issue-resolving protective measures. The principle of prohibition against excessively low protection applies as a standard of judicial review to the relationship between a wronged party and the state and the principle of prohibition against excessive restriction applies to that between a wrongdoer and the state. The two principles above require different analysis and serve different functions. Therefore, as the standard of judicial review, a combination of the two principles has to apply to the constitutional rights’ triangular relationship that features a holistic examination of the three relationships.
