This article examines the necessity and the possibility of establishing the normative structure models for the cyberspace, which substitutes the cyberspace social norms. As the necessity of the normative frame has been increased, this article tries to consider the normative characteristics of the cyberspace presuming that the establishment of the normative cyber structure is needed. It is for sure that there has not been many studies with respect to the normative structure of the cyberspace. Thus, this article suggests that there can be 4 different types of the normative frames or models for the cyberspace. The first model is to provide the cyberspace constitution, which gives rise to many difficulties for the structure regulating the cyberspace, for it is so hard to follow, so to speak, the constitutional principles in the cyberspace, such as, the principle of democracy, the equal protection before the laws, and etc. In reality, the users in the cyberspace have very little interest in the democratic governance in the virtual space. With respect to the equality provided under the Korean constitution article 11, the usage or the availability of the equal protection gives many questions to the protection for the users in the cyberspace as well. In this regard, it should be examined whether the constitutional rights can be denoted to various rights promulgated by the basic law regulating the cyberspace, which gives more weight on having the basic law to frame the cyberspace. However, it also gives rise to many problems to extract the concrete rights applied to the cyberspace users and virtual relations in reality. In addition, the declaration of the cyberspace rights also gives us very little help to address the normative difficulty of the cyberspace structure. Ultimately, considering pros and cons above, this article insists that it would be better off trying to make the basic law regulating cyberspace with declaration of the rights of the cyberspace, which can make the cyberspace more normative and stable.
