최근 저출산과 고령화로 인한 인구감소 현상이 심화되면서, 빈집 문제가 사회적 이슈로 대두되고 있다. 특히, 농촌 및 중소도시 지역에서 빈집의 증가는 지역사회의 경제적 침체, 범죄 발생 증가, 환경 훼손 등 다양한 사회 문제를 야기하고 있다. 이러한 빈집 문제는 단순히 개인의 재산 관리 문제가 아니라 공익적 관점에서 접근해야 할 필요성이 있다.
본 연구는 빈집 문제의 법적 쟁점을 심층적으로 분석하고, 이를 해결하기 위한 국가 및 지방자치단체의 역할을 재조명하는 것을 목적으로 한다. 특히, 빈집정비사업의 현황과 문제점을 파악하고, 빈집의 철거, 매입, 수용 등과 관련된 공법적 쟁점을 검토함으로써 빈집 문제해결을 위한 법제도적 개선방안을 제시하였다.
연구의 주요 내용은 다음과 같다. 첫째, 빈집정비사업의 개념과 절차, 현황을 살펴보고, 빈집의 정의왿� 특성을 분석하였다. 빈집은 실정법상 개념으로 빈집 및 소규모주택 정비에 관한 특례법과 농어촌정비법에서 규정하고 있으며 이는 지방자치단체의 빈집정비사업의 대상이 된다.
둘째, 사회국가원리왿� 빈집정비정책의 관계를 검토하였다. 사회국가원리에 따라 국가뿐만 아니라 지방자치단체도 정의로운 사회질서 형성을 위한 의무를 지니며 빈집 문제해결을 위한 개입과 조정은 헌법적 근거를 가진다. 또한, 빈집 인인의 주거권과 빈집 소유자의 재산권이 충돌하는 상황에서 입법자가 빈집정비법과 농어촌정비법을 통해 공익을 위해 재산권을 제한할 수 있음을 확인하였다.
셋째, 빈집의 철거, 매입, 수용에 대한 공법적 검토를 통해 현행 법령의 문제점과 개선 필요성을 제시하였다. 빈집 소유자의 관리 및 정비의무가 명시적으로 규정되어 있지 않아 철거명령의 법적 근거가 불명확하고 철거비용의 상계 및 보상액 산정에 있어서 형평성 문제가 존재한다. 또한, 빈집의 매입과 수용에 있어서 대상 범위왿� 절차에 대한 법적 근거가 미비하여 법제도적 개선이 요구된다.

결론적으로, 빈집 문제는 국가 및 지방자치단체, 빈집 소유자 등이 상호 협력하여 종합적으로 접근해야 하며 법제도의 개선과 함께 빈집 소유자의 자발적인 참여를 유도하는 정책적 노력이 필요하다. 이를 통해 빈집 문제가 지역사회 발전의 걸림돌이 아닌 새로운 기회로 전환될 수 있을 것이다.

With the intensifying phenomena of low birth rates and an aging population, the issue of vacant houses has emerged as a significant social problem in South Korea. Particularly in rural areas and small to medium-sized cities, the increase in vacant houses is leading to various societal issues such as economic stagnation, rising crime rates, and environmental degradation. Addressing the vacant house problem requires an approach from a public interest perspective rather than viewing it merely as a matter of individual property management.
This study aims to conduct an in-depth legal analysis of the vacant house problem and re-examine the roles of the state and local governments in resolving it. Specifically, by identifying the current status and issues of vacant house maintenance projects and reviewing public law-related legal issues concerning the demolition, purchase, and taking of vacant houses, the study seeks to propose legal and institutional improvement measures for solving the vacant house problem.
The main contents of the study are as follows. First, the concept, procedures, and current status of vacant house maintenance projects are examined, and the definition and characteristics of vacant houses are analyzed. Vacant houses are legally defined in the Special Act on the Promotion of Urban Regeneration and the Agricultural and Fishing Villages Improvement Act, serving as the basis for local governments’ vacant house maintenance projects.
Second, the relationship between the social state principle and vacant house maintenance policies is reviewed. Under the social state principle, not only the state but also local governments have the obligation to form a just social order, and intervention and coordination to solve the vacant house problem have constitutional grounds. Additionally, in situations where the residential rights of neighbors of vacant houses conflict with the property rights of vacant house owners, it is confirmed that legislators can limit property rights for the public interest through the Vacant House Maintenance Act and the Agricultural and Fishing Villages Improvement Act.
Third, through a public law examination of the demolition, purchase, and taking of vacant houses, the study points out issues in current legislation and the need for improvement. The lack of explicit provisions on the management and maintenance obligations of vacant house owners leads to unclear legal grounds for demolition orders, and there are issues of fairness in the offsetting of demolition costs and the calculation of compensation amounts. Furthermore, legal grounds concerning the scope and procedures for the purchase and taking of vacant houses are insufficient, necessitating legal and institutional improvements.
Fourth, the study re-examines the role of local governments in solving the vacant house problem. To promote the voluntary participation of vacant house owners, various support measures such as providing vacant house consultation services and introducing a vacant house bank are proposed. Emphasis is placed on the need for active support from local governments to enable vacant house owners to effectively resolve issues such as sale, lease, and demolition.
In conclusion, the vacant house problem requires a comprehensive approach through cooperation among the state, local governments, and vacant house owners. Policy efforts are needed to improve legal systems and induce the voluntary participation of vacant house owners. Through this, the vacant house problem can be transformed from an obstacle to regional development into a new opportunity.
