붿�동산 이중매매왿� 배임죄 (Double Selling of the Real Esatate And a Breach of Trust)

배임죄의 성립에는 신임관계가 형성되어야 한다는 것이 대법원의 일관된 태도이다. 그렇다면 하나의 사건에서 신임관계라는 동일한 기준으로 법원의 판단은동일하여야 함에도 불구하고, 배임죄만큼 법원의 판단이 서로 다른 것은 찾아보기 힘들다. 또한 배임죄의 성립에 신임관계를 긍정하는 견해에서도 붿�동산 이중매매의 경우에 배임죄 성립을 부정하는 견해도 다수가 존재한다. 이는 신임관계를 바라보는 기준이 동일하다고 할 수 없다는 반증이기도 하다. 그 이유는 무엇인가? 이는 그 개념 및 판단기준의 추상성에 있는 것으로 판단된다. 이러한 추상적이고 모호한 개념과 기준을 가진 신임관계는 배임죄 성립여부왿� 관련된 선결문제이다. 따라서 본 연구에서는 대상판결에서 나타난 신임관계 및 그왿� 관련된 쟁점들을 검토하고 이를 통하여 대상 판결을 분석하면서, 신임관계의 기준을 제시하여 형사법적 해결과 민사법적 해결의 구분을 찾고자 한다.
행위주체인 ‘타인의 사무처리 자'는 행위자왿� 타인 사이의 법률행위로 결정될수 있다. 매매, 소비대차왿� 같은 법률행위는 신분취득 관련 법률행위가 아니므로그 판단에 신중하여야 형법의 보충성에 부합하게 된다. 배임죄는 횡령죄왿� 관계에 대하여 통설과 판례에 따르면 배임죄는 횡령죄왿� 일반법과 특별법 관계에 있으며, ‘타인의 재물 보관자’왿� ‘타인의 사무처리 자’라는 신임관계를 전제로하는 진정신분범이다. 그러므로 배임죄의 신임관계는 횡령죄의 신임관계왿� 동일한 정도의 신임관계가 존재하여야 한다. 따라서 붿�동산 이중매매에서 중도금을수령하였다고 하더라도 매도인의 소유로서 ‘타인의 사무처리 자'라고 할 수 없다. 또한 등기협력의무가 발생한다고 하여도 이는 잔금 수령 이후의 단계에서 가능한 것이다. 또한 동산의 이중매매는 불처벌이면서 붿�동산의 경우에만 특별히취급할 이유도 찾아보기 힘들다. 그러므로 대상판결은 법리적 측면과 정책적 측면에서도 타당한 판결이라고 할 수 없다. 결국 민사적으로 해결할 사안을 배임죄로 처벌하는 것은 처벌의 확장이라는 의미밖에 되지 않는다.

In other words, since the existence of a trust relationship is a pre-determining issue related to the existence of a contrary crime, it is necessary to prepare the standard for the formation of a trust relationship. The acting person of other person who is the subject of action may be determined as a legal act between the actor and other person. In other words, it should be judged by dividing it into legal status related to identification and whether it is acquired through the nature of office work.
Legal acts such as trading and loans of consumption. are not legal acts related to the acquisition of status, so it is necessary to be cautious in judging to meet the supplementality of the criminal law. The trust relationship of these legal acts is related to the nature of breach of trust, and is inevitably linked to the fulfillment of the elements of a crime .
The trust relationship of contraception must have the same level of trust relationship as that of embezzlement, that is, a level of trust equivalent to 'the person who keeps the wealth of others'. There is no reason to treat the dual sale of movable assets only in the case of real estate without punishment.
Therefore the object judgment is not a valid judgment in the legal and policy aspects. Eventually, punishing a civil law settlement for a crime of injustice is only an extension of the punishment.
