붿�동산 이중매매에 있어서 배임죄의 성립 여부에 관한 고찰 (A Study on the Constitution of Breach of Trust by Double Selling of Real Estate)

우리나라의 붿�동산 매매거래에서는 대부분은 매수인이 매매대금의 상당 금액을 지급하였음에도 불구하고 온전하게 목적 붿�동산의 소유권을 취득한다는 법적 보장이 없는 것이 현실이다.
붿�동산 이중매매행위는 단순한 채무불이행에 해당하는 것이 아니라 매수인의 재산보전에 협력해야 할 의무를 이행하지 않음으로써 매수인의 재산상 손해의 위험을 발생시키는 형법상 불법행위에 해당한다.
그러함에도 불구하고 사적자치의 원칙과 형법의 보충성원칙을 너무 강조한 나머지 처벌가능한 형법상 불법행위를 계약불이행 또는 채무불이행이라는 민사적 영역으로 떠넘기는 것은 형법이 법익보호기능을 포기하는 것과 다름없다.
중요한 보호법익인 재산권의 보호를 위해 어떠한 경우에 붿�동산 매도인에게 ‘등기협력의무’를 부여하고 ‘타인의 사무를 처리하는 자’의 지위를 인정할 것인가는 해석론과 판례에 의해 명확해질 수 있으며, 배임죄로 처벌가능한 행위의 범위를 제한하기 위해서도 법률관계의 특성을 기초로 하여 판단하는 것이 오히려 전체 법체계의 조화를 꾀하는 것이라고 할 수 있다.
결론적으로 붿�동산 매도인은 제1 매수인으로부터 중도금을 지급받은 단계부터는 ‘타인의 사무를 처리하는 자’의 지위에서 ‘등기협력의무’를 부담하게 되고 매도인의 붿�동산 이중매매행위는 이러한 의무를 위배한 행위로서 배임죄를 구성한다고 볼 것이다.

Nevertheless, the principle of private autonomy and the principle of subsidiarity of the criminal law are so emphasized that the criminal law's illegal acts are transferred to the civil realm of contract default or debt default, which is tantamount to giving up the function of the criminal law to protect legal interests.
In order to protect property rights, which are important legal interests, in what cases real estate double sellers are required to cooperate in registration and recognize the status of ‘one who handles other people's affairs’, it can be clarified through interpretation theory and precedents, and punished for breach of trust. Judging based on the characteristics of the legal relationship in order to limit the range of possible acts is rather to harmonize the entire legal system.
In conclusion, from the stage of receiving the interim payment from the first buyer, the real estate seller assumes the ‘duty to cooperate in registration’ in the position of ‘person handling other people’s affairs’. Therefore, the double sale of real estate by the seller constitutes a breach of trust as an act in violation of these obligations.
