저당지상의 건물에 대한 일괄경매청구권 (Claim for bundle auction of building together with mortgaged land)

우리 민법은 토지왿� 건물을 별개의 붿�동산으로 취급하고 있다. 따라서 토지왿� 건물의 소유권이 동일인에게 귀속되지 않는 상황이 발생할 수 있다. 이 경우 토지 소유자는 건물 소유자를 상대로 토지 소유권의 행사를 통하여 건물의 철거왿� 토지의 인도를 청구할 수도 있다. 특히 토지에 저당권이 설정되었다가 실행되는 경우, 동일한 소유자에게 속하였던 토지왿� 건물의 소유자가 달라질 수 있으며, 이 경우 건물은 철거되어야 하는 상황에 처할 수도 있다. 그런데 건물이 철거되는 경우, 사회경제적 손실이 생길 수도 있고, 저당권자에게는 담보가치를 유지함에 어려움이 있게 되고, 저당권의 실행에서도 곤란함이 생길 수 있다. 민법은 저당권의 실행 등으로 인하여 토지왿� 건물의 소유자가 달라지는 상황에 대비하여 양자의 소유권을 동일인에게 귀속시키려고 하거나 또는 건물의 소유자에게 토지에 관한 용익권을 부여하기 위한 제도적 장치를 마련하고 있다. 그것이 바로 민법 제365조가 규정하고 있는 토지저당권자의 일괄경매청구권 또는 민법 제366조의 법정짿�상권이다.
본 논��은 민법 제365조의 일괄경매청구권에 관하여 현행법상의 해석을 둘러싼 학설과 판례의 논의를 살펴본다. 그리고 민법상 일괄경매제도의 존재이유를 검토한다. 이러한 과정을 통하여 민법 제365조의 해석상 한계가 있으며, 최근 담보법의 현대화의 움직임에 맞추어 일괄경매제도의 개정방향에 관하여 검토한다. 이 과정에서 일본 민법 제389조의 일괄경매청구권에 관한 규정 내용을 간단히 검토한다.
결론적으로 현행 민법 제365조의 일괄경매제도의 개정필요성은 있으며, 그러한 개정방향을 통하여 토지의 소유권과 이용권의 적절한 조화를 기할 필요가 있다.

Korean civil code regards the building as separate real estate from the land. Therefore, it could be occurred that the ownership of the building and the land do not belong to the same subject. According to article 365 of Korean civil code the mortgagee of land is entitled to claim an auction of the building together with mortgaged land, if the building was constructed by security provider after the settlement of the mortgage. The primary purpose of this rule is not only to prevent of the removal of the building, which may be cause of social-economic loss, but also to protect the interest of the mortgagee of the land. This paper is made to review the requirements of bundle auction and to propose the revision of article of 365 of Korean civil code.
The requirements of the blanket auction of the building in question on the secured land are as follows; Firstly, it is required that the security provider of land constructs the building after the settlement of the security on the land. Secondly, it is demanded that the mortgagor of the land own the building. However, it is discussed in the literature whether it is possible for the mortgagee to claim the blanket auction, if the third party construct the building on the secured land. Korean Supreme Court recently sentenced that the mortgagee has the right for the bundle auction, though the a usufructuary of the secured land contructed the building. The decision of the court is supported by the majority of the academia. There are various viewpoints, which try to expand the possibility of blanket auction through the interpretation the article 365 of Korean civil code. Nonetheless, it is not simple.
Under the circumstances there are some suggestions for amendment of article 365 of Korean civil code. This paper examine the legislative suggestions in respect of bundle auction of the building together with mortgaged land. In conclusion, the paper suggests the new provision on bundle auction. According to the proposed provision the blanket auction is allowed, if the sucurity provider or the third party constructs the building on the secured land. It is not the matter, who is the owner of the building at the execution of mortgage.
