After the termination of medical care for work-related injuries, care benefits are provided for those recognized to require medical care due to residual disabilities (Article 61 of the Industrial Accident Compensation Insurance Act). Care benefits are provided for the purpose of guaranteeing the right to live as a human being for industrial accident victims and practically assisting them to carry out minimal daily activities even if they cannot engage in labor. However, the current Industrial Accident Compensation Insurance Act ambiguously expresses the recipients of caregiver benefits as ¡®those who need care,¡¯ and the types of benefits are unified as ¡®the expenses incurred for caregiving.¡¯. Therefore, it is difficult to clarify the scope of care intended to be guaranteed through this care benefit system.
In relation to this, through the criteria for determining the recipients of care benefits and their interpretation, I¡¯d like to discuss that the current Industrial Accident Compensation Insurance Act¡¯s caregiving benefits do not adequately provide support to those injured individuals who actually need caregiving, and that more specific and detailed evaluation methods are needed regarding the necessity of caregiving and the payment of benefits. Especially regarding the necessity of caregiving and the payment of benefits, I examine the standards of another caregiving support system, the ¡°Act on Long-Term Care Insurance for Senior Citizens,¡± and compare the regulations on caregiving benefits in Germany and Japan, which, like South Korea, have worker¡¯s compensation laws as a form of universal social insurance. Based on this comparison, we review improvements to the current system.
