This study examines the problem of maintenance fee from aggregate building which is now common type of residence with analytic and legislative basis. Since there are not enough concrete regulations regarding importance of maintenance fee in aggregate building act, it causes various problems. Particularly, the succession of maintenance fee in arrears from a former owner of partitioned to a new receiver of aggregate building has been a problem. Supreme Court upon this divided them into exclusive area and common area, and judged that only maintenance fee in arrears of common area can succeed to the new owner of partitioned. Despite of this decision, theories are sill against each other. Now, it becomes the problem that the law must step in. In last 19th National Assembly, 3 revised legislative bills are suggested concerning maintenance fee of aggregate building. Since every bill, including these 3 bills, has many problems as the body illustrates, jurisdiction scholar can¡¯t afford to accept this. There isn¡¯t no problem in content and term, but main reason is from misunderstanding about legislative intent of aggregate building act. Because aggregate building act basically has judicial personality, its legislative intent is totally different from public housing management act or housing act which have strong legal elements. Therefore, even if management and supervision are really needed, it is not allow to apply legal regulations to aggregate building act unconditionally. In other words, regulation or supervision must be kept to a minimum. Revision of aggregate building act should continue in 20th National Assembly as well. In the short run, aggregate building act Article 18 should be revised first, which matters the most in legal practices. And a purification work of terms will be needed with ¡®easy¡¯ civil law, for example, revision of Japanese term ¡®¼¯•þ(rally)¡¯ that even Japanese scholars criticized should be implemented and upon the other terms. Furthermore, in the long run, revision for relationships between public housing management act, housing act and aggregate building act has to be done with study on the effectiveness of management rule.
