The essential function of a lien is to emphasize the correlation that the secured claim of lien arises from the object of lien, and to guarantee preferential payment from the object of lien. Therefore, the direction of amendments of the lien should be set in such a way as to supplement the current lien system instead of abolishing the lien. In other words, (1) to prevent harm caused by false or exaggerated liens, as the Housing Lease Protection Act, etc. stipulates, the preferential payment effect should be recognized if a fixed date is specified in the document evidencing the claim; however, for the value increase and preservation amount of the object due to the lien holder, the right to priority preferential payment should be recognized by dualizing the preferential payment right. (2) It is necessary to consider the introduction of a lien registration order system so as to preserve the right by giving the lien holder the same opposing power as possessing the object in a situation where the lien holder is unable to occupy the object and to prevent socioeconomic loss resulting from the possession of the object. The amendments should be made in a direction that the principle of extinction is adopted in the auction procedure and the buyer is guaranteed the acquisition of the complete right to the object of lien only by paying the sale price. (3) To prevent disputes over lien rights, it is desirable to recognize the subcontractorโ€™s right to claim direct payment to the contractee, and establish a provision that the contractor cannot claim a payment equivalent to the subcontract price to the contractee, and that the contractor cannot seize or transfer the contractual claim to the contractee within the scope of the subcontractorโ€™s subcontractual claim. (4) The right to request an auction for the execution of the security right to the lien should be recognized. (5) In consideration of the reality that disputes over lien rights for buildings under construction occupy a significant proportion, a registration system for real estate under construction should be established so that lien holders can exercise their security rights.
