Last August, Gahan authorized emergency maintenance to fill the area with rock, but he did so without first getting the necessary state and federal permits.
The U.S. Army Corps of Engineers Louisville District sent a cease-and-desist letter to the city to remove the rock fill.
The same month, the Indiana Department of Natural Resources filed a request for a permanent injunction in Floyd County Superior Court.
In documents obtained by 비바카지노 Viva, the Indiana DNR wanted the city to remove any fill materials and apply for the proper permits to replace the fill.
Seven months later, the legal process continues, and the fill at the dam remains.
Just recently, the Indiana DNR filed a request for a default judgment, saying the city has refused to attend depositions after receiving proper notice, and the city has failed to respond to discovery requests.
In more legal filings, the Indiana DNR says the fill continues to adversely restrict the floodway, impact fish and wildlife, and pose a hazard to safety.
In response to the Indiana DNR's motion for default judgment, the city filed for an extension.
There is now a hearing set for later this month.
The city has still not submitted restoration plans to the U.S. Army Corps of Engineers.
This past January, the Corps approved a six-month extension for the city to submit plans.

In granting the 6-month extension, we considered the ongoing preliminary injunction issued by the Floyd Superior Court 3 in Cause No. 22D03-2408 PL-001309.
